These Terms & Conditions govern your use of Fatafat France’s website, mobile app, and delivery services. By accessing or using any part of our platform, you agree to be legally bound by these Terms & Conditions. If you do not agree with any part of these Terms & Conditions, please do not use our services.

All images displayed on the platform are for reference purposes only. Actual product appearance or packaging may differ.


2. Service Description

Fatafat France provides fast online delivery of groceries, household products, Indian food items, and other daily essentials across France. Our services are accessible through our website and mobile application and include:

  • Two-hour express delivery in select areas, including Paris
  • Same-day delivery for other locations
  • Scheduled deliveries within available time slots

Product availability may vary depending on your delivery address and the time of ordering.


3. Eligibility and Account Use

You must be at least 18 years old to create an account and place orders. You agree to:

  • Provide accurate, complete, and current registration information;
  • Keep your account login credentials secure; and
  • Take responsibility for all activities under your account.

Fatafat reserves the right to suspend or terminate accounts that breach these Terms & Conditions or are suspected of fraudulent activity.


4. Orders, Modifications, and Cancellations

Orders can be placed via our mobile app or website. Once confirmed, orders may not be canceled or modified except in exceptional circumstances with customer support approval.

Fatafat reserves the right to cancel any order due to:

  • Product unavailability;
  • Operational or technical issues;
  • Pricing or listing errors;
  • Suspected fraud or abuse.

You will be notified of any such cancellation and refunded as appropriate.


5. Delivery Policy

Delivery times are estimates and not guaranteed. Delays may occur due to weather, traffic, strikes, or unforeseen logistical challenges.

Delivery will be attempted at the address provided during checkout. If you are unavailable at the time of delivery, or if incorrect or incomplete delivery details are provided, the order may be canceled or rescheduled at Fatafat’s discretion.

Delivery fees, if applicable, will be clearly shown during the checkout process and may vary depending on location and order size.


6. Payment Terms

We accept the following payment methods:

  • Debit and Credit Cards (Visa, MasterCard);
  • PayPal;
  • Cash on Delivery (COD), where available.

All online transactions are processed through secure payment gateways using encryption technologies. For COD, please have the exact amount ready, as change may not always be provided.


7. Refunds and Returns

Refunds may be granted in the following cases:

  • Incorrect or missing items;
  • Expired or spoiled products;
  • Damaged or tampered packaging;
  • Non-receipt of order.

Refund requests must be submitted within 12 hours of delivery, along with supporting photo or video evidence. Refunds will be processed to the original payment method or as store credit, depending on the situation.

Returns are not accepted unless the product is defective or not as described. Items must be returned in their original condition and packaging.


8. Expiry and Perishable Goods Policy

We ensure that:

  • Fresh items (fruits, vegetables, dairy, breads, etc.) have sufficient shelf life upon delivery;
  • Packaged items have a minimum of 30 days before expiry unless otherwise stated;
  • Short-dated or clearance items are clearly marked and discounted.

If a product is spoiled internally, despite appearing fine externally, customers must report the issue within 12 hours of delivery with proof. We will issue a refund or replacement based on product type and availability.

Note: Perishable items are non-returnable under Article L221-28 of the French Consumer Code.

9. Promotions and Coupons

Promotional codes, offers, and discounts are subject to specific terms and availability. They are valid only for the time period specified and cannot be combined unless stated otherwise.

Misuse of promotions may result in account suspension or order cancellation.


10. Intellectual Property Rights

All website and app content, including text, logos, product listings, icons, and graphics, is the exclusive property of Fatafat France or its licensors. Any unauthorized use, reproduction, or distribution is prohibited without prior written consent.


11. User Conduct

Users agree not to:

  • Use the platform for unlawful purposes;
  • Violate any local or international laws while using our services;
  • Interfere with platform functionality or the experience of other users;
  • Submit false reviews or content infringing on intellectual property or privacy rights.

We reserve the right to suspend or terminate access for violations.


12. Limitation of Liability

Fatafat France shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or goodwill arising from your use of the service.

Our total liability for any claim will not exceed the total order amount paid by the user, unless otherwise mandated by applicable law.


13. Indemnification

You agree to indemnify and hold harmless Fatafat France, its affiliates, and employees against any claims, losses, or damages arising from:

  • Your misuse of the service;
  • Your breach of these Terms & Conditions; or
  • Your violation of applicable laws or third-party rights.

14. Modifications to the Terms

Fatafat reserves the right to modify these Terms & Conditions at any time. Changes will be posted on this page with the updated effective date. Continued use of our platform after such changes constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms & Conditions shall be governed and interpreted in accordance with French law. Any dispute arising in connection with these Terms will fall under the exclusive jurisdiction of the courts of France.


Terms & Conditions for Fast Delivery Service – Fatafat France

1. Service Scope and Availability

  • Fast Delivery guarantees delivery within 2 hours of order acceptance.
  • This service is currently available only in the Paris 75 department and selected eligible zones within this area.

2. Eligibility

  • Orders must be placed within designated service hours and before stated cut-off times to qualify for Fast Delivery.
  • Only products marked as eligible for Fast Delivery can be ordered under this service.
  • Delivery availability depends on stock, location, and logistical feasibility.

3. Order Placement and Confirmation

  • Fast Delivery orders must be placed via our website or mobile app and will be confirmed via email or app notification.
  • Once confirmed, changes or cancellations are not permitted except in exceptional cases handled directly by customer support.
  • Orders placed after cut-off times will be processed under standard delivery options.

4. Delivery Commitments

  • We aim to deliver orders within 2 hours from order confirmation.
  • Delivery times are estimates and may be affected by unforeseen circumstances such as traffic, weather, or operational issues.
  • If a delay occurs, Fatafat will notify the customer as soon as possible.

5. Delivery Attempts and Customer Responsibility

  • Delivery will be attempted at the provided address during the specified time window.
  • If the recipient is unavailable, or if incorrect or incomplete address details are given, Fatafat may reschedule or cancel the order at its discretion.
  • Additional delivery attempts or changes may incur extra charges.

6. Delivery Charges

  • Fast Delivery fees will be clearly indicated at checkout and may vary by location and order size.
  • Promotional offers on delivery fees may apply as per current promotions.

7. Payment

  • Payment methods accepted for Fast Delivery orders include debit/credit cards, PayPal, and cash on delivery where applicable.
  • Payments are processed securely via encrypted payment gateways.

8. Refunds and Returns

  • Refunds for Fast Delivery orders are processed only for valid issues such as wrong, damaged, or missing items.
  • Refund claims must be submitted within 12 hours of delivery with supporting evidence (photos/videos).
  • Returns are generally not accepted unless products are defective or not as described. Return items must be unopened and in original packaging.

9. Limitation of Liability

Expiry Date & Perishable Goods Policy – Terms & Conditions

At Fatafat France, we are dedicated to delivering fresh, high-quality products that are safe for consumption. Please carefully review our terms related to expiry dates and product conditions below.


1. Expiry Guarantee

  • Fresh and perishable products (such as fruits, vegetables, dairy, breads, etc.) are delivered with sufficient shelf life to ensure safe consumption.
  • Packaged groceries (dry goods, snacks, beverages) are delivered with a minimum of 30 days before their expiry date, unless otherwise stated.
  • Short-dated products will be clearly marked and sold at discounted prices.

2. Perishable Goods – Internal Damage

Despite our careful sourcing and handling, some perishable items may occasionally be:

  • Internally spoiled;
  • Bruised, overripe, or rotten inside; or
  • Damaged during transit in ways not visible externally.

If you receive such products, please:

  • Report the issue within 12 hours of delivery;
  • Provide clear photo or video evidence showing the internal condition; and
  • Include your order number and product name.

Upon verification, we will issue a replacement or refund depending on product type and availability.


3. Non-Refundable Situations

Refunds or returns will not be accepted for:

  • Products delivered within their valid shelf life as per the listing;
  • Damage resulting from delayed storage, improper handling, or partial use/consumption;
  • Complaints made after 12 hours of delivery.

Note: Perishable items (e.g., fresh fruits, dairy, meat) are non-returnable due to hygiene and safety regulations under Article L221-28 of the French Consumer Code.


4. Refund or Replacement Eligibility

Refunds or replacements are provided only if:

  • The product is expired at the time of delivery; or
  • The product is damaged, spoiled, or leaking; and
  • The issue is reported within 12 hours with supporting proof.

5. Storage Responsibility

Once delivered:

  • Customers are responsible for immediate refrigeration or appropriate storage of perishable goods.
  • Fatafat France is not liable for spoilage caused by delays or improper storage by the customer.

Fatafat France reserves the right to update or modify this policy at any time.

Terms & Conditions - Partners

Products Supplied by Third-Party Partners / Vendor Responsibilities


1. Platform & Marketplace Role

Fatafat operates as an online marketplace and logistics platform connecting consumers with local Indian businesses across France.

  • In some cases, Fatafat acts as a commercial distributor by procuring pre-packaged or ready-to-sell products from verified third-party brands.
  • In other cases, Fatafat merely facilitates the sale between a seller (partner) and the customer by offering a digital platform for listing, ordering, and payment processing.

In all situations, Fatafat is not involved in the manufacturing, preparation, or modification of any food or grocery products sold.


2. Product Sourcing & Compliance

All products offered through the Fatafat platform are sourced from independent third-party suppliers (our “Partners”), who are fully responsible for:

  • Ensuring compliance with all applicable French and EU food safety regulations, including HACCP standards and Regulation (EC) No. 852/2004
  • Maintaining proper hygiene, packaging, labeling, and shelf-life control
  • Holding valid licenses, approvals, and food business registrations required under French law
Fatafat does not prepare, cook, or alter any food or perishable items. All products are sold in the exact form received from the Partner.

3. Limitation of Liability

By using the Fatafat platform, you acknowledge and agree that:

  • Fatafat is not liable for the quality, hygiene, or safety of any product provided by third-party suppliers.
  • The Partner brand is solely and exclusively responsible for ensuring the product complies with French food laws, labeling rules, allergen declarations, and hygiene standards.
  • In the event of any issues (e.g. foodborne illness, allergic reactions, expired goods, labeling errors), any legal responsibility shall lie with the third-party supplier, not Fatafat.

Fatafat’s role is strictly limited to:

  • Displaying the product on the platform
  • Enabling the transaction (order placement and payment)
  • Coordinating delivery logistics

Fatafat is not a producer or food operator (au sens de l’article 3 du Règlement (CE) 178/2002) and accepts no liability for issues arising from the handling, preparation, storage, or ingredients of products sold by Partners.


4. Consumer Complaints & Dispute Resolution

If you experience an issue with a product (e.g. defect, damage, non-conformity), you may contact [email protected] within 12 hours of delivery. We will do our best to:

  • Forward your complaint to the responsible partner
  • Assist with communication or dispute resolution

However, Fatafat will not be held liable for any losses, injuries, damages, or non-compliance arising from a product sourced from a third-party brand.

You may also pursue direct legal action or complaint with the responsible partner, whose identity may be disclosed upon request for legal purposes.

5. No Warranty or Guarantee

Fatafat does not provide any warranty or guarantee, express or implied, regarding:

  • The merchantability, fitness, or safety of the goods
  • Product origin or allergen risk
  • Accuracy of labeling or packaging from the supplier

All guarantees are the sole responsibility of the supplying partner.


6. Legal Jurisdiction

These terms are governed by French law. Any dispute arising from a product’s quality or safety shall be directed to the original seller or supplier. Fatafat shall not be party to any legal proceedings related to product defects, contamination, illness, or regulatory violations by third-party brands.


7. Final Declaration

By placing an order on Fatafat, you acknowledge:

  • You are purchasing goods sourced from third-party suppliers
  • Fatafat is not the producer, preparer, or food handler
  • All product-related liability rests solely with the supplying partner
